Acceptable Uses Policy(AUP)

Introduction -- As an Internet service provider ("ISP"), Limo.Net Internet Services, here after referred to as Limo.Net offers its subscribers the means to acquire and disseminate a wealth of public, private, commercial and non-commercial information.
Customer: any person, persons or organization inquiring about or using services or facilities provided by Limo.Net. Client, subscriber, user or responsible account holder; is synonymous with the term 'customer'.
Limo.Net also wants its subscribers to be fully informed of their rights and obligations -- and those of Limo.Net -- in connection with their use of the Internet. This Acceptable Uses Policy, which supplements and explains certain terms of each customer's respective services agreement (the "Services Agreement"), is intended as a plain English guide to those rights and obligations.

General -- Limo.Net reserves the right to append, amend or change the meaning or content of these conditions with out notice. Subsequent revisions shall be made available to the customer upon request. Limo.Net makes no warranties of any kind, expressed or implied, for services or equipment provided or purchased through it's business . Limo.Net also disclaims any warranty of merchantability or fitness for a particular purpose. This includes any loss, interruption or corruption of data stored on or being moved through Limo.Net's network or systems. Limo.Net is not responsible for unlawful acts or use of its services by the customer or for any damage or harm to others, their hardware, software or person resulting from such use of its services. Limo.Net does not guarantee the privacy of client's data or transmissions.

The dialup connection to the Internet provides for full access to all available information on the Internet. This information has an extremely wide range of topics, quality and value. Some of this material has high educational value. While some material may be distasteful or otherwise offensive. Limo.Net has no restrictive mechanisms that will prevent this material from being accessed. The customer is responsible for the content and form of the communications. Any information the client obtains through the use of Limo.Net's services is at the risk of the client. The client assumes responsibility for all activity of their account and any fees or penalties associated with this activity.

Unlimited hours of use is defined as Internet service for which there is no overall monthly limit on total hours of reasonable use currently users are limited to 200 hours of usage on a rolling 30 day basis.. The intent of it is to remove the customers worry for additional charges for over use. Abuse of this intent is defined as, activity or connected hours which suggest the customers computer is connected while the customer is away from or not using the system. For example during times of sleep, work and school. Limo.Net prohibits the use of any program that "keeps a connection alive," sustaining a connection to Limo.Net service for the sole reason to wait for possible incoming e-mail, and sustaining a connection while working on non-Internet related programs. Limo.Net reserves the right to set data transmission rates for a minimum acceptable rate per connection period.

Hardware and Software -- Limo.Net is not responsible for problems with the client's telephone connection, software, computer hardware, or operator error. While Limo.Net makes every effort to provide quality service, Limo.Net cannot guarantee the client will never get a busy signal or experience temporary service outages. The quality of the client's telephone signal may vary, and is the responsibility of the telephone company. Limo.Net cannot make any guarantee of bandwidth or throughput over the Internet or connection speeds. Limo.Net is not responsible for the equipment compatibility of the customers computer software or hardware.

Billing -- All accounts are considered active at the time of sign up. The service is made available by Limo.Net, and is the client's choice weather to use the service or not. The account will continue to accrue debt regardless of the use or nonuse by the client until a properly processed request for termination has been received in writing (see 'Cancellations/Terminations' below). Payments can be automatically charged to a major credit card for each invoiced period. Automatic billing is performed on the 20th of each month for all accounts with due dates falling before the next billing date. Check and money order payments may be mailed to: Limo.Net Internet Services, 181 34th Ave SW, Albany, OR. 97322-3849. Cash payments must be presented to our office at, 181 34th Ave SW, in Albany, (during normal business hours). Postal and email invoices are generated twice each month. Unless requested all invoices will be sent via electronic or email to the primary account holders email on record. US Postal Mailing of invoices must be requested and will be charged an additional $2.50 Postal Invoicing Fee each billing cycle. To prevent additional service charges, payment for the amount invoiced is due by the cited due date. Payment must be received before that date to reduce the possibility for interruption of service. Any account with unpaid balances on the due date can incur a late fee. Any account with unpaid balances 10 days following the due date of invoice will be denied dial-up access automatically by our accounting software. If account balances are left unpaid for 30 days, the account is subject to be deleted, and will be assessed a $45.00 administrative termination fee, to cover the cost of the bookkeeper, in addition to any service charges or late fees. These accounts will be sold to a collection agency if left unpaid. All accounts will acquire debt until proper cancellation is received. A minimum charge equal to the setup fee and one month of service is required on all accounts that are cancelled in less than thirty days of the create date. Active accounts beyond the first thirty days are paid to term and no refunds will be paid.

Cancellations/Terminations -- Cancellation of accounts must be made in writing by postal mail to Limo.Net Internet Services, 181 34th Ave SW, Albany, OR 97322-3849. Accounts will be marked for deactivation with in five days of the receipt of the request. Requests for cancellation must be received 20 days prior to the next due date to prevent termination processing fees and the generation of a new invoice. Once the system creates an invoice for the next billing cycle it becomes a valid debt and is recorded as accounts receivable. Any request for termination after the invoice is generated will incur a termination processing charge of $45.00 to cover the cost of the bookkeeper. An audit of the account will be conducted and a final invoice will be mail to the account holder on record. Refunds are issued only to accounts that are cancelled within the first thirty days of service. Cancellations after the first thirty days will be pulled on the last paid day of service. Limo.Net is not responsible for failure of any media delivery system of an account termination request. Telephone cancellations and email cancellations will not be accepted.

Suspensions -- Limo.Net reserves the right to limit, suspend, or cancel the service of any client that Limo.Net feels has violated this agreement. In the case of account closure due to policy violations, the client will be subject to loss of the entire unused balance on their account. Limo.Net will not tolerate any of its personnel being subjected to profane, abusive, or threatening language. Such activity will result in the immediate termination of the client's account without refund or appeal. Limo.Net reserves the right to monitor any transmission through our service. Limo.Net reserves the right to access any data that is stored on a Limo.Net server.

Unauthorized Activity -- Spam is a term referring to posting of messages into unrelated newsgroups or posting of messages into several newsgroups at one time, and sending of unsolicited email. Clients will not use the email service for chain letters, junk mail, or any use of distribution lists to any person who has not given specific permission to be included in such a process. Clients who participate in such activity will immediately have their accounts suspended pending the outcome of investigations. The client agrees to pay administration fees and losses incurred as a result of his or her actions that provoke denial of service attacks against Limo.Net. This includes the clean up and repair of the servers and files as a result of such things as email bombs, virus attacks, or any other denial of service attacks.

Legal disputes -- In any legal proceedings to enforce this agreement, the losing party agrees to pay the prevailing party's attorney fees and costs, at trial and on appeal. No agent, employee or representative of Limo.Net has the authority to bind the parties to any representation or warranty unless such is specifically included in these terms and conditions, the Limo.Net Service Order Form, or with a written amendment thereto. Notice to parties of disputes arising under this agreement shall be sent by certified mail, return receipt requested, to the parties address shown on the most recent service order.

The fundamental fact about the Internet is that no one --neither Limo.Net, nor anyone else -- owns or controls it. This fact accounts for much of the Internet's openness and value, but it also places a high premium on the judgment and responsibility of those who use the Internet, both in the information they acquire and in the information they disseminate to others. When subscribers obtain information through the Internet, they must keep in mind that Limo.Net cannot monitor, verify, warrant or vouch for the accuracy and quality of the information that subscribers may acquire. For this reason, the subscriber must exercise his or her best judgment in relying on information obtained from the Internet, and also should be aware that some material posted to the Internet is sexually explicit or otherwise offensive. Because Limo.Net cannot monitor and censor the Internet, and will not attempt to do so, Limo.Net cannot accept any responsibility for injury to its subscribers that results from inaccurate, unsuitable or offensive Internet communications.

When subscribers disseminate information through the Internet, they also must keep in mind that Limo.Net does not review, edit, censor or take responsibility for any information its subscribers may create. This places on subscribers what will be, for most, an unfamiliar responsibility. When users place information on the Internet, they have the same liability as other authors for copyright infringement, defamation and other harmful speech. Also, because the information they create is carried over Limo.Net facilities and may reach a large number of people, including both subscribers and nonsubscribers of Limo.Net, subscribers' postings to the Internet may affect other subscribers and may harm Limo.Net's goodwill, business reputation and operations. For these reasons, subscribers violate Limo.Net policy and the Services Agreement when they, their affiliates or subsidiaries engage in the following activities:

Spamming -- Unsolicited, commercial mass e-mailing (known as "spamming") is a strongly disfavored practice among Internet users and service providers. It is particularly harmful not only because of its negative impact on consumer attitudes toward Limo.Net, but also because it can overload Limo.Net's equipment and disrupt service to Limo.Net subscribers. Spam is a term referring to posting of messages into unrelated newsgroups or posting of messages into several newsgroups at one time, and sending of unsolicited email. Clients will not use the email service for chain letters, junk mail, or any use of distribution lists to any person who has not given specific permission to be included in such a process. Clients who participate in such activity will immediately have their accounts suspended pending the outcome of investigations. The client agrees to pay administration fees and losses incurred as a result of his or her actions that provoke denial of service attacks against Limo.Net. This includes the clean up and repair of the servers and files as a result of such things as email bombs, virus attacks, or any other denial of service attacks

Copyright Violation -- Violation of copyrights held by individuals and corporations or other entities can result in civil and criminal liability for the infringer, and can involve the ISP in litigation and possible loss of reputation.

Distribution and/or Transmission of Obscene or Indecent Speech or Materials -- Violation of indecency and obscenity laws can result in criminal penalties.

Defamation -- Defamatory speech distributed over the Internet can result in civil liability for the defamer and litigation against the ISP whose facilities were used to distribute the defamatory material.

Illegal/Unauthorized Access to Other Computers or Networks -- The illegal or unauthorized accessing (often known as "hacking") of computers or networks carries potential civil and criminal penalties under both federal laws and the laws of most states.

Distribution of Internet Viruses, Worms, Trojan Horses and Other Destructive Activities -- Distribution of Internet viruses, worms, Trojan horses and other destructive activities, such as hacking, can result in serious civil and or criminal liability under federal and state law.

Export Control Violations -- The law limits the ability of persons to export encryption software, over the Internet or otherwise, to points outside the United States.

Other Activities --  Whether lawful or unlawful, that Limo.Net determines to be harmful to its subscribers, operations or reputation, including any activities that restrict or inhibit any other user from using and enjoying the service or the Internet.

As we have pointed out, the responsibility for avoiding the harmful activities just described rests primarily with the subscriber. Limo.Net will not, as an ordinary practice, monitor the communications of its subscribers to ensure that they comply with Limo.Net policy or applicable law. When Limo.Net becomes aware of harmful communications, however, it may take any of a variety of actions. Limo.Net may remove information that violates its policies, implement screening software designed to block offending transmissions, or take any other action it deems appropriate, including termination of a subscriber's contract with Limo.Net.

Subscribers who knowingly transmit materials that violate law or Limo.Net policy are, themselves, in violation of Limo.Net policy. Similarly, Limo.Net anticipates that subscribers who offer Internet services will cooperate with Limo.Net in any corrective action that Limo.Net deems necessary, in order to correct and prevent the transmission of material that is harmful to Limo.Net or its subscribers. Failure to cooperate with such corrective and preventive measures is a violation of Limo.Net policy.

Limo.Net also is concerned with the privacy of on-line communications. In general, the Internet is neither more nor less secure than other common communications media, including mail, facsimile and voice telephone service, all of which can be intercepted and otherwise compromised. As a matter of prudence, however, Limo.Net urges its subscribers to assume that all of their on-line communications are insecure.

Limo.Net can not take any responsibility for the security of communications transmitted over Limo.Net's facilities. Limo.Net will comply fully, however, with all applicable laws concerning the privacy of its subscribers' on-line communications. In particular, Limo.Net will not intentionally monitor or disclose any private electronic mail messages sent or received by its subscribers unless required to do so by law. Limo.Net may, however, monitor its service electronically to determine that its facilities are operating satisfactorily. Also, Limo.Net may be required to disclose information transmitted through its facilities in order to comply with court orders, statutes, regulations or governmental requests. Finally, Limo.Net may disclose information transmitted over its facilities where necessary to protect Limo.Net and its subscribers from harm, or where such disclosure is necessary to the proper operation of the system.

Limo.Net Internet Services believes that shared wireless networks are in keeping with our core values of disseminating knowledge, access to information and fostering community, provided this usage does not have an adverse impact on the services of other customers, does not involve any illegal activity and is not otherwise in violation of any aspect of our existing Terms Of Service. Please remember that the Limo.Net Internet Services account-holder is responsible for all activity originating from their DSL line, even if it is the result of other users on a shared wireless connection.

Finally, Limo.Net wishes to emphasize that in signing the Services Agreement, subscribers indemnify Limo.Net for any violation of the subscriber of the Services Agreement, or of law or Limo.Net policy, that results in loss to Limo.Net or the bringing of any claim against Limo.Net. This means that if Limo.Net is sued because of activities of the subscriber that violate any law, the Services Agreement or this policy (which is part of the Services Agreement), the subscriber will pay any damages awarded against Limo.Net, plus costs and reasonable attorneys' fees.

We hope this Policy Statement is helpful in clarifying the obligations of Internet users, including Limo.Net and its subscribers, as responsible members of the Internet. Last modified: November 13th, 2007.
